Terms of Service

1. Acceptance of Terms

By accessing or using PodNotes ("the Service"), operated by Palavir LLC ("we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PodNotes provides AI-powered podcast transcription and content generation tools. We reserve the right to modify or discontinue features at any time with reasonable notice.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload malicious content or attempt to compromise the Service
• Resell or redistribute the Service without written permission
• Exceed rate limits or abuse API endpoints

5. Payment & Billing

Paid plans are billed in advance on a monthly or annual basis through Stripe. Refunds are available within 14 days of initial purchase. Cancellation takes effect at the end of the current billing period.

6. Intellectual Property

You retain ownership of all audio content you upload and generated outputs. We retain ownership of the Service, its design, and underlying technology. AI-generated content (show notes, summaries) is provided for your use but should be reviewed before publishing.

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Palavir LLC shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your account for violation of these terms. You may delete your account at any time from Settings. Upon termination, your data will be permanently deleted within 24 hours.

9. Changes to Terms

We may update these terms with 30 days notice via email. Continued use after changes take effect constitutes acceptance.

10. Governing Law

These terms are governed by the laws of the State of Michigan. Any disputes shall be resolved in the courts of Oakland County, Michigan.
